Emergency Order regarding 15mph Speed Limit

ORDER PURSUANT TO THE DECLARATION OF DISASTER AND EMERGENCY

TO ALL RESIDENTS AND PERSONS WITHIN THE MUNICIPALITY OF THE TOWNSHIP OF LONG BEACH IN THE COUNTY OF OCEAN AND STATE OF NEW JERSEY AND TO ALL DEPARTMENTS OF THE MUNICIPAL GOVERNMENT OF THE TOWNSHIP OF LONG BEACH

WHEREAS, pursuant to the powers vested by Chapter 251 of the laws of 1942, as amended and supplemented, N.J.S.A. App. A: 9-30, et seq.; N.J.S.A. 40:48-1, et seq.; and all applicable statutory law and regulations, as well as the Chapter 105 of the Township Code, the Township of Long Beach (“Township”) declared on March 24, 2020, that a local disaster/emergency exists within by and through the required authorization of the Director of Public Safety and the Emergency Management Coordinator; and 

WHEREAS, the aforesaid laws and declaration of emergency authorize the promulgation of such orders, rules, and regulations as are necessary to meet the various problems which have or may occur due to such an emergency, and

WHEREAS, as a direct result of the ongoing Covid-19 pandemic and local emergency, there has been a significant increase in pedestrian traffic on Beach Avenue and Ocean Avenue; and 

WHEREAS, the existing speed limit on Beach Avenue and Ocean Avenue poses an immediate threat to the public health, welfare, and safety in light of the significant increase in pedestrian traffic caused by the Covid-19 pandemic and local emergency; and 

WHEREAS, in order to protect the public health, welfare, and safety, the Township has elected to lower the speed limit on certain portions of Beach Avenue and Ocean Avenue, as provided herein; 

NOW, THEREFORE, in accordance with the aforesaid laws and recitals, which are incorporated herein by reference, it is promulgated and declared that until further Order of the Township that:

  1. Effective immediately, the speed limit on Beach / Ocean Avenue between 31st Street and 121st Street (MacAvoy) shall be reduced to 15 miles per hour.  
  2. Effective immediately, the speed limit on Atlantic Avenue between S 34th Street and 13th Street shall be reduced to 15 miles per hour.  
  3. The Township Police Department shall be charged with the enforcement of the terms of this Order; and 

D. Penalties for violations of this Order may be imposed under, among other statutes, N.J.S.A. App. A:9-49 and -50, and the Township Code.  

E. The reduced speed limits shall terminate on October 16, 2020.
